Jiang Atelier has a right to reject or refuse commission inquiries or proposals. Clients also have a right to reject commission proposals from Jiang Atelier.

Jiang Atelier Terms of Service: Rights

Clients have no right in any scenario to make cryptocurrency, AI generated artworks, or NFTs (non-fungible tokens) from the product or services of Jiang Atelier.

Jiang Atelier has a right to reject or refuse commission inquiries that any Artisan deems inappropriately offensive or discriminatory.

Jiang Atelier products and services have a Streaming License included that is calculated into the initial price given to the Client. Please click Here to read the full Streaming License. If the Client wants to remove the Streaming License, a price can be negotiated with the Artisans providing the product or service.

Jiang Atelier Artisans have the right to the manner and method of creating any product or service for the Client. The Client has no right to control the Artisan’s manner and method of performance. Jiang Atelier will ensure the Artisan uses their best efforts to provide the product or service to the Client’s specification to the best of their ability and to submit all products or services to the Client in publishable professional quality on or before the applicable deadlines. 

Jiang Atelier Artisans have the right to select the delivery of the product or services in whatever file format they see best fit. The client has a right to verify that the product or services delivered are suitable for the commissioned purpose and can request certain file formats if it is within the Jiang Atelier Artisan’s ability to provide those specific file formats.

All communications must be kept in email, Twitter, or Discord without modifying or deleting any messages for transparency and accountability of both parties. 

Clients must properly credit and recognize Jiang Atelier and the involved Artisans when posting about the product or service commissioned on any public platform such as Twitter, Twitch, Youtube, Instagram, Tiktok, etc. Proper credit is defined by mentioning or tagging Jiang Atelier’s and involved Artisans’ social media, mentioning the names of the artist and the product or service received, and keeping Jiang Atelier on a designated credits page made by the Client.

Jiang Atelier recognizes its responsibility to keep all confidential information of the Client confidential. Confidential Information refers to any data or information relating to the Client whether business or personal, which would reasonably be considered to be private or proprietary to the Client and that is not generally known and where the release of that information could reasonably be expected to cause harm to the Client. Jiang Atelier agrees that it will not disclose, divulge, reveal, report or use, for any purpose, any confidential information except as authorized, approved, and consented to by the Client in a recorded agreement. This obligation will survive the expiration, completion, or termination of the commission of products or services from Jiang Atelier and will continue indefinitely from the date of such expiration, completion, or termination of the commission. All written and oral information and materials disclosed or provided by the Client to Jiang Atelier under this agreement is confidential information regardless of whether it was provided before or after the initial date of the commission inquiry or proposal.

Jiang Atelier and the involved Artisans have the right to punish any Clients that break the rules of the Terms of Service including but not limited to blacklisting and denial of refund requests.

Jiang Atelier is not responsible for the loss of quality or damages caused by the reproduction or distribution of our products or services by the Client or third parties. Jiang Atelier will not issue a refund for a product or service damaged or corrupted by a third party. 

Failure to read the Terms of Service properly is not the responsibility nor liability of Jiang Atelier. Any mistakes from the Client as a result of not thoroughly reading the Terms of Service is fully the responsibility and liability of the Client, not the Artisans or Jiang Atelier. The Client is subject to all terms and requirements of the Terms of Service regardless of whether they read it through or not. 

In case of emergency situations from the Artisans, some terms will be waived if proper notice is given to the Client at the time of the emergency.
